GENERAL TERMS AND CONDITIONS

1. Scope

These General Terms and Conditions apply to all contracts for the ordering and delivery of goods via the online shop (prints, illustrations, or vouchers) concluded between the customer (hereinafter also referred to as “consumer”) and the seller (KATINKA INK / Kathleen Mertsch). Deviating terms and conditions of the customer shall not be recognized unless the seller expressly agrees to their validity in writing.

2. Conclusion of Contract

2.1 The product descriptions contained in the seller’s online shop do not constitute binding offers by the seller but serve as an invitation to the customer to submit a binding offer.

2.2 The customer can submit the offer via the order form integrated in the online shop. By placing the selected goods in the virtual shopping cart and completing the electronic ordering process, the customer submits a legally binding contractual offer by clicking the order button.

2.3 The seller can accept the customer’s offer within five days by:

  • sending a declaration of acceptance or order confirmation via separate email,

  • delivering the goods, or

  • processing the payment transaction via a payment service provider. The timing of the payment transaction depends on the selected payment method (see “Payment Terms”).

2.4 The order processing and communication usually take place via email and automated order processing. The customer must ensure that the email address provided for order processing is correct and able to receive emails from the seller. In particular, when using spam filters, the customer must ensure that all emails sent by the seller or authorized third parties can be delivered.

3. Prices and Payment Terms

3.1 All prices include the statutory VAT (if applicable) plus shipping costs. The amount of shipping costs is displayed during the ordering process.

3.2 For deliveries to countries outside the European Union, additional costs may be incurred (e.g., transfer fees, exchange rate fees, customs duties) which must be borne by the customer.

3.3 The available payment methods are indicated in the online shop.

 

4. Delivery and Shipping Conditions

4.1 Delivery is made to the delivery address provided by the customer within the specified delivery area. If PayPal is chosen as the payment method, the address stored in PayPal at the time of payment is decisive.

4.2 The delivery time is usually 3–7 business days.

4.3 If delivery fails for reasons the customer is responsible for, the customer shall bear the costs incurred by the seller. This does not apply if the customer exercises their right of withdrawal effectively. For return shipping costs, the provisions in the seller’s withdrawal policy apply.

5. Right of Withdrawal

Consumers have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period begins on the day the goods are received. To exercise the right of withdrawal, a clear statement (e.g., by email) must be sent to:

5.1 Consequences of Withdrawal

After withdrawal, all payments received (including standard shipping costs) will be refunded within 14 days. The refund may be withheld until the goods are returned or proof of return is provided. The goods must be returned within 14 days. Return shipping costs are borne by the customer.

5.2 Exclusion or Premature Expiry of the Right of Withdrawal

The right of withdrawal does not apply to:

  • Delivery of custom-made products (e.g., personalized prints)

  • Delivery of digital vouchers, if the execution has begun with the customer’s explicit consent before the withdrawal period expired

6. Retention of Title

The goods remain the property of the seller until full payment has been made.

7. Warranty

The statutory warranty rights apply to consumers.

8. Applicable Law

8.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers outside Germany, this applies only insofar as mandatory provisions of their country of residence are not disregarded.

8.2 For consumers outside the EU, the right of withdrawal is limited if the delivery address is also outside the EU.

9. Alternative Dispute Resolution

9.1 The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr

9.2 The seller is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

 

 

 

 

 

 

TATTOO APPOINTMENTS

1. Appointment Booking / Deposit

Tattoo appointments are arranged individually (in person, via email, or through social media).
A deposit is required to confirm a booking. This deposit will be credited towards the final price.
If a cancellation is made less than five days before the appointment, the tattoo artist reserves the right to retain the deposit as a cancellation fee.
If the client fails to show up without prior notice, the deposit will be forfeited entirely.

2. Tattoos – Health and Liability

The client confirms that they are of legal age (at least 18 years old) and in a physical and mental condition suitable for receiving a tattoo.
Tattoos are done at the client’s own risk. The tattoo artist accepts no liability for allergic reactions, infections, or other complications resulting from insufficient aftercare or undisclosed pre-existing conditions.
Before the tattooing process begins, the client will receive detailed information about potential risks and aftercare.
Filling out and signing a consent form is mandatory.

3. Design and Copyright

All tattoo designs and motifs are protected by the copyright of KATINKA INK.
Use, reproduction, or sharing of designs — especially with other tattoo artists — is prohibited without the explicit consent of the artist.
If no appointment is made, the exclusive usage rights to the design remain with the artist.

4. Prices and Payment

Tattoo prices depend on effort, design size, and desired style. Prices will be communicated transparently and agreed upon in advance.
Payment is made on-site, either in cash or via agreed payment methods (e.g., debit card or online payment).
